General terms and conditions
This contract is entered into between GymNeva SàRL (hereinafter referred to as "GymNeva") and GymNeva SàRL (hereinafter referred to as "GymNeva").
"GymNeva") and You (hereinafter referred to as the "Member").
Services
Subscribing to a Pack gives you access to your GymNeva Centre, including access to the equipment and services provided.
Packs & validations
Packs are nominative and cannot be shared or passed on to a third party under any circumstances. All our Packs are valid for a maximum of 6 months from the date of purchase. Our Packs are valid for a maximum of 2 months from the 1st session booked.
Age-related conditions
The Member certifies that he/she is at least 18 years old. For persons aged between 8 & 18, exceptions are granted with the signature of a parent or guardian.
Rules of procedure
The Member declares that he/she has read the internal regulations and adheres unreservedly to the rules of health and safety. He/she undertakes to :
- Wear specific, clean sports clothing and footwear.
- Use a cloth on appliances and clean your equipment after use.
- Behave in a pleasant and respectful manner towards others.
Cloakrooms & lockers
Individual lockers are available for Members to leave their personal belongings in while they train.
Their use is limited to the duration of the session. GymNeva will open and empty the lockers of any Members who are not present at the Centre.
Lost or stolen items
GymNeva accepts no responsibility for the loss or theft of personal belongings, even if they are locked in a locker.
Using the Centre
The Centre's premises may only be used for sports training. No other activity will be tolerated, under the following conditions

Access and safety conditions
GymNeva is open 7/7 except in exceptional circumstances. The Member accepts that the Centre may be placed under video surveillance. The data recorded is archived for 30 days before being deleted. The Member undertakes not to allow any other person access to the Centre without GymNeva's prior authorisation.
The Member may be held liable for any resulting damage.
Cancellation at GymNeva's initiative
The Pack may be terminated immediately and automatically by GymNeva,
- If the Member's attitude or behaviour does not comply with this contract or the Centre's internal rules.
- In the event of non-payment, the Member will remain liable for the remaining sessions due for any Pack partially or fully used.
Payment & late payment
The Member undertakes to pay for the Pack in accordance with the conditions stipulated in the contract. It is the Member's responsibility to ensure that payment is made. If payment is not made on time, the Member will be refused access to the Centre until the amount due has been settled. GymNeva may pass the case on to a debt collection company, which may add irrevocable additional costs. Temporary suspension does not entitle the Member to any extension.

Renewal and termination terms
Packs are taken out without tacit renewal. The Member is therefore free to extend an expiring Pack by taking out a new one.
Extension: A Pack may be postponed by the Member for medical reasons (on presentation of a medical certificate), or for service reasons.
military service (on presentation of the official summons). The Pack may be suspended for a period of between 1 and 6 months (with a maximum deferral of 9 months in the event of pregnancy), and will be automatically reactivated at the end of this period. No deferment will be granted retroactively.
Pack transfer
It is exceptionally possible to transfer the Pack to a third party with the written agreement of GymNeva. To do this, the Member must notify
GymNeva of its intention and communicate the information relating to the new Member. The new Member must accept the membership contract, and
will take over the current Pack, valid for the duration initially stipulated in the original contract. Administrative costs of CHF 50 must be paid by the customer.

Rate changes
Prices are guaranteed for the duration of the contract. The price may be revised when the Pack is renewed. In this case,
GymNeva will inform the Member by e-mail before the new prices are applied.
Communication
GymNeva communicates mainly by e-mail. GymNeva declines all responsibility if the e-mail address does not exist, is not
not valid or if for any reason the e-mails are not delivered. For ecological reasons, GymNeva does not, in principle, communicate to the
paper format.
State of health
The Member certifies that his/her physical condition and state of health allow him/her to practice a sport and that the practice of physical activities does not risk altering his/her state of health, safety or physical condition. If in doubt, the Member should seek medical advice to confirm that he/she is fit to take part in a sporting activity. It is not GymNeva's responsibility to have the Member undergo a fitness test, or any other test, in order to determine his/her physical condition. The sole purpose of any test carried out by GymNeva would be to gather comparative data in order to evaluate the progress of the Member.
Under no circumstances may this test be used as a medical diagnostic tool.
Insurance
The Member confirms that he/she is covered for any bodily injury he/she may suffer in the event of an accident or incident during his/her training. GymNeva cannot be held responsible in the event of an incorrect declaration made by the Member as to his/her physical condition or in the event of injury resulting from an incapacity, reduction or any other alteration to his/her physical condition.
Member's liability
The Member is responsible for any damage to property or bodily injury that he or she may cause, through his or her own fault, within GymNeva and undertakes to pay all costs inherent in such damage, on presentation of an invoice or written statement.
Liability waiver
The Member acknowledges that he/she is aware of the risks involved in using the facilities to which he/she has access at GymNeva. It is the Member's responsibility to inform himself/herself about the use of the facilities made available to him/her; GymNeva may not be held liable in the event of physical or material damage, following any accident resulting from failure to observe safety rules or inappropriate use of the equipment or other facilities.
Jurisdiction and applicable law
These general terms and conditions of sale, as well as any problem relating to access to GymNeva, use of the Centre and the facilities, are subject exclusively to Swiss law, without regard to the principles of conflict of laws. Any dispute that may arise between the Member and GymNeva concerning these terms and conditions of sale, access to the Centre and use of the facilities shall be subject to the jurisdiction of the ordinary courts of the place where GymNeva has its registered office.
